1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the website besseller.in (the “Site”) and the services offered by BesSeller Ecom Services (“BesSeller”, “we”, “us”, or “our”). By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

2. About BesSeller

BesSeller Ecom Services is an independent eCommerce services agency that helps brands with listing optimisation, A+ content, storefront design, advertising management, product photography, and related eCommerce marketing services. BesSeller is a member of the Amazon Solution Provider Network, a directory Amazon maintains of independent service providers. BesSeller is not affiliated with, endorsed by, or acting on behalf of Amazon. Please also read our Disclaimer.

3. Use of the Site

When you use the Site, you agree that you will not:

• Use it for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to the Site, its servers, or any connected systems.
• Interfere with or disrupt the Site, or introduce malicious code.
• Copy, reproduce, or republish content from the Site without our written permission.

4. Services and Engagements

The Site provides general information about our services and does not by itself create a contract. A service engagement begins only when the scope, deliverables, timelines, and fees are agreed between you and BesSeller in writing (including by email or a signed proposal). The specific terms of each engagement, together with these Terms, form the agreement between us. Where a specific engagement term conflicts with these Terms, the engagement term will prevail for that engagement.

5. Fees and Payment

Fees for each engagement are as set out in the applicable proposal or invoice. Unless stated otherwise, invoices are payable in full by the due date shown. We may pause or suspend work on overdue accounts. Cancellations and refunds are governed by our Refund & Cancellation Policy.

6. Client Responsibilities

To deliver our services effectively, we rely on you to provide accurate information, timely approvals, and any access, brand assets, or credentials that a task reasonably requires. You are responsible for ensuring that any materials you provide (such as images, text, or product claims) are accurate, lawful, and do not infringe the rights of others. You are also responsible for complying with the policies and terms of any third-party platform, including Amazon, on which your account or products appear.

7. Intellectual Property

All content on the Site — including text, graphics, logos, and the BesSeller name and marks — is owned by or licensed to BesSeller and is protected by applicable intellectual property laws. Deliverables we create for you under an engagement become yours once payment is received in full, unless the engagement states otherwise. Any third-party names, logos, or trademarks referenced on the Site (including “Amazon”) remain the property of their respective owners.

8. No Guarantee of Results

We bring skill and experience to every engagement, but eCommerce outcomes depend on many factors outside our control — including marketplace algorithms, competition, pricing, inventory, seasonality, and the policies and decisions of third-party platforms such as Amazon. We do not guarantee any specific ranking, sales volume, revenue, advertising return, or other result. Any figures, case studies, or examples shown on the Site are illustrative and are not a promise of comparable results.

9. Third-Party Platforms

Our services often involve working within third-party platforms such as Amazon. Those platforms are controlled by their operators, who may change their features, policies, or fees, or may suspend or restrict accounts, at any time. We are not responsible for the acts, omissions, or decisions of any third-party platform, and such events are outside the scope of our liability.

10. Limitation of Liability

To the maximum extent permitted by law, BesSeller will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Site or our services. To the extent we are found liable, our total liability for any claim will not exceed the fees you paid to us for the specific engagement giving rise to the claim.

11. Indemnity

You agree to indemnify and hold BesSeller harmless from any claim, loss, or expense arising out of materials you provide to us, your breach of these Terms, or your violation of any law or third-party rights, including the policies of any platform on which your products or account appear.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the courts at Palghar, Maharashtra, India.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when we post the revised Terms on the Site and update the “Last updated” date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
